These Terms govern your use of Roller Derby Legacy, a free historical archive of roller derby. By using the service or contributing materials, you agree to these Terms.

Roller Derby Legacy is operated by NoJo Enterprise Co., Ltd. (株式会社NoJo Enterprise), a company organized under the laws of Japan, with its principal office in Kanagawa Prefecture, Japan. References to “Roller Derby Legacy,” “we,” “us,” and “our” mean that legal entity.

Contributor content and platform review

Roller Derby Legacy is a free historical archive that receives materials and information from contributors around the world. We cannot independently authenticate the copyright ownership, provenance, identity, date, factual accuracy, or legal status of every submitted item.

We may use automated checks, security scanning, community review, archival research, and administrative review, but these processes do not constitute a guarantee that every contribution is accurate, authorized, complete, or free from third-party claims.

We are entitled to rely reasonably on the information, representations, permissions, and rights selections supplied by contributors unless we become aware of credible information indicating a problem.

We may restrict, unpublish, annotate, correct, preserve privately, or remove Content while investigating a copyright, privacy, safety, legal, or historical-accuracy concern.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Contributions

If you contribute materials, your submission is governed by the Contribution & Archival License Agreement, which includes a worldwide non-exclusive archival license and consent to watermarking and technical derivatives. Please read it carefully before contributing.

Acceptable use

You agree not to submit malware, unlawful content, deliberately false rights information, or content intended to harm another person, and not to misuse or attempt to disrupt the service.

Contributor indemnity

To the extent permitted by law, you agree to compensate Roller Derby Legacy and its operator for reasonable losses, liabilities, judgments, and external legal expenses directly resulting from your knowing or material breach of your rights warranties, deliberate submission of unlawful material, fraudulent rights information, or failure to disclose a known restriction.

This obligation does not apply to losses caused by Roller Derby Legacy’s intentional misconduct, gross negligence, unauthorized use outside the granted license, or failure to take action required by applicable law.

Good-faith dispute resolution

Before filing a non-urgent contractual claim arising from use of the Service, a user must send written notice describing the dispute and requested resolution and allow 30 days for good-faith discussions.

This requirement does not prevent either party from seeking urgent injunctive relief, preserving a limitation period, reporting a matter to a regulator or law-enforcement authority, or exercising a right that cannot lawfully be restricted. It binds only users who accepted these Terms; it does not bind a third-party photographer, person depicted, estate, regulator, or rights-holder who never agreed to the Terms.

Governing law and jurisdiction

These Terms, the Contribution Agreement, and contractual disputes arising from them are governed by the laws of Japan, without regard to conflict-of-laws rules that would require application of another jurisdiction’s law.

To the extent permitted by applicable law, the Yokohama District Court and the Yokohama Summary Court shall have exclusive agreed jurisdiction as the courts of first instance for contractual disputes arising out of or relating to these Terms, the Contribution Agreement, or use of the Service.

Nothing in this clause excludes mandatory rights, jurisdiction, remedies, regulatory authority, or legal obligations that cannot lawfully be excluded by agreement.
